On the international base, there is about 45 classification in trademark classes. Trademarks are classified according to the goods or services which they cover. This is a very important part when you are applying trademark classification. To classify between the category of good service you are opting for your business.

Trademark Classes: What Are They?

The trademark classes are popularly known as Nice Classification.

The United States Patent and Trademark Office (USPTO) began using the International classes. The classification of goods and services is from 1-34 its category of good and from34-45 it for service. People who are willing to register a trademark application must comprehend these categories well. We will discuss all the categories in detail in the following paragraphs.

The Nice Classification is the standard adopted by various countries all over the world. It even allows for much higher flexibility and coordination among the trademark offices of those countries. It also benefits trademark proprietors in the abroad because it explains and decreases the cost of applying to register their marks in foreign countries. Moreover, the trademark classification makes handling a trademark search easier. Even the less time-consuming for a trademark attorney because the search can be narrowed to cover only the appropriate class or classes.

Importance of Trademark Classes

The USPTO trademark classification system works 2 important functions: First, it gives a guideline to businesses for enrolling their goods or services for registration. Next, it assists in identifying potential trademark infringers.

The USPTO is not liable to register a trademark that may seem so same to an existing registered trademark that it may confuse as to the source of the goods/services. There is a possibility that the same name can be registered but the condition is the product need to be different. An example Dove it’s a soap and chocolate. In such a situation, both trademarks can co-exist as they relate to different classes of goods.

With trademark classes in place, it enhances comfort for the USPTO to recognize the same trademarked goods and services that are different and have been filed under relevant classes. They also help companies searching for the same trademarks because they can search in their class, supporting them to monitor new applications for trademark and identify any possible infringements.
